Timpani Store — Terms of Service

Last updated: 23 October 2026

1. About these Terms

Timpani Beatz ("we", "us" or "our") offers digital music products and studio services through Timpani Store at https://timpanistore.com. "Timpani Beatz" is our public-facing brand and licensor designation. "You" means the customer or website user and, where you act with authority for a business, that business.

These Terms cover website use, purchases and studio services where they have been properly disclosed and validly incorporated into the relevant agreement. Merely browsing does not constitute consent to unrelated charges or a waiver of legal rights.

Read the applicable product description, checkout information and any accepted project offer alongside these Terms. Our related documents are:

The Licensing Terms govern product-use permissions, and the Refund Policy governs refunds and cancellations, including their provisions protecting existing agreements. The Privacy Policy explains personal-information processing; referring to it is not blanket consent to processing. Nothing here overrides applicable mandatory law or reduces rights under an earlier binding agreement.

2. Using the website

You must have the legal capacity and any authority required to enter your agreement. If local law requires a parent or guardian's involvement, obtain that involvement before ordering. Provide accurate information and use only payment methods you are authorised to use. Protect any account credentials and private download links, and tell us if you suspect unauthorised access.

You must not use the store for fraudulent transactions or unlawful activity; access accounts or systems without authorisation; introduce malware; misuse checkout, discount or download functions; or deliberately disrupt the store or another user's access. These rules do not prohibit lawful criticism, complaints, reviews or the exercise of consumer rights.

3. Digital products and licences

Our products include Paid and Free Loop Kits, Multi-Kits, samples, presets, sound libraries, production tools and audio plugins when available. A planned or previewed product is not available to purchase unless expressly offered for sale.

Digital products are licensed, not supplied as transfers of copyright ownership. Your rights to use the identified materials come from the applicable Licensing Terms and any valid, disclosed product-specific agreement.

In particular, melodic loops are not royalty-free. Applicable publishing splits, publishing coordination, separate major-placement clearance and source-file redistribution restrictions remain in force. Paid and Free Loop Kits carry the commercial music permissions stated in the Licensing Terms; free does not mean unrestricted. Multi-Kit permissions depend on the material category used. These Terms introduce no new split, clearance fee or licensing restriction.

Review the disclosed formats, functionality and compatibility before ordering, and ask us if something is unclear. This does not reduce our responsibility for accurate descriptions, promised compatibility or legally required remedies. Any additional software licence must be disclosed before the relevant purchase; buying presets does not license third-party plugin software.

4. Orders, prices and payments

Review the products, quantities, email address, currency, total price, applicable taxes and any discount before submitting an order. A paid order authorises payment of the disclosed checkout total through your selected payment provider. The store uses Shopify Checkout and currently offers PayPal Express; only the payment options actually displayed are available.

Your electronic order confirmation records the purchase details. Keep it and the applicable terms. Payment authorisation does not transfer intellectual property ownership. For a free product, complete the required zero-price checkout; no product purchase price is charged.

Prices and offers may change for future orders, but changes do not retrospectively increase an agreed price. Taxes are those applicable to the transaction and disclosed as required; these Terms create no tax exemption.

If we discover a material order, description or pricing error, we will explain it and seek an appropriate resolution. We will not silently charge a higher amount or substitute a materially different product. Your rights concerning an accepted order remain protected.

We may decline an unaccepted order or reasonably pause processing to investigate credible fraud, unauthorised payment or a legal restriction. We will communicate where lawful and handle any payment for an unfulfilled or cancelled order under the Refund Policy and applicable law. This is not a right to cancel accepted orders arbitrarily.

5. Digital delivery and download access

Files are supplied electronically through Fileflare Digital Downloads following successful payment or completion of a free checkout. The current configuration provides automatic digital fulfillment and email delivery, up to five download attempts per file, and no configured time-based expiration.

Provide an accurate checkout email address and check relevant inbox folders. If a confirmation or file is missing, a link fails, or an archive is incorrect or corrupted, contact us with the order details. We will investigate and provide the delivery assistance or remedy required by the Refund Policy and applicable law.

The absence of a time-based expiration is not a promise of unlimited downloads, uninterrupted access or permanent file hosting. Keep a secure personal backup of lawfully downloaded files. Download limits and backup advice do not remove legally required delivery, access or remedies. Do not publish or share private customer download links.

6. Refunds, cancellations and mandatory rights

All digital product sales are final and non-refundable, except where a refund or other remedy is required by applicable law. We offer no voluntary money-back guarantee, satisfaction guarantee or change-of-mind refund period. The published Refund Policy explains the applicable rules and support process.

Where EU or UK consumer distance-selling rules apply, any loss of a digital-content cancellation right requires the legally required prior express consent to early supply, acknowledgement of the loss of that right and contract confirmation in a form the customer can retain. Downloading alone or accepting these Terms or the Refund Policy does not meet those conditions. Rights concerning defective or misdescribed content remain separate.

Service cancellations and any lawful charges for work performed are governed by the Refund Policy, applicable law and project terms agreed before booking. These Terms create no deposit, cancellation fee or fixed refund percentage.

7. Mixing, mastering and custom production

Studio services include Mixing & Mastering and Custom Music Production, including custom beats, full song production, vocal production and arrangements where agreed.

Before work begins, we agree the scope, required customer materials, price, payment arrangements, delivery terms, deliverables and revision arrangements for the project. The current advertised Mixing & Mastering offer includes three free revisions. Revision arrangements for other work follow the accepted offer; no unlimited revision entitlement is implied.

Supply the agreed materials and information needed for the work. If something missing affects the project, we will discuss the effect and any necessary adjustment. We will not impose an undisclosed extra charge. Additional work or a material change of scope requires a separate agreement before it is charged.

We remain responsible for the agreed work and any legally required standard of care and skill. Ownership, publishing, credits or licences for newly created project contributions must be addressed in the project agreement; ordering a service alone is not an automatic copyright buyout.

8. Materials you submit

You and the relevant rights holders retain your respective rights in demos, beats, vocals, stems, reference tracks, project files and other materials you send us. Supply only materials you are authorised to provide for the requested purpose, and tell us about relevant restrictions.

You give us only the permission reasonably necessary to receive, access and use those materials to assess and respond to your inquiry or perform an accepted project. Submission does not transfer ownership or authorise unrelated commercial release, resale or promotion of your music. Any wider permission requires a separate agreement.

Sending music does not, by itself, create a production agreement, publishing agreement, partnership or obligation to accept a project. Personal-information handling remains subject to the Privacy Policy.

9. Our content and third-party rights

Timpani Beatz and the relevant rights holders retain their respective rights in protected branding, original music materials, product artwork, website content, descriptions and creative assets. Do not copy, resell, redistribute or commercially exploit protected content without permission, except as allowed by the applicable licence or law.

We do not claim ownership of third-party trademarks, recordings, software or other materials we do not own. Product-specific rights, permitted finished music releases and restrictions on source files are governed by the Licensing Terms.

10. Creative and commercial outcomes

Buying a product or service does not guarantee a major-artist placement, label agreement, streaming revenue, industry opportunity, commercial success or an artistic outcome not expressly agreed. This does not excuse failure to provide an expressly accepted deliverable or meet an obligation or remedy required by law.

11. Platforms and external services

Shopify operates the ecommerce platform, PayPal processes payments offered through its service, and Fileflare supports digital delivery. External social platforms and other providers may apply their own terms to the services they provide.

Our agreement with you remains distinct from those provider relationships. A provider interruption or an external link does not automatically remove our responsibility for your purchase, delivery or mandatory remedies. The Privacy Policy explains relevant processing of personal information; these Terms do not replace it.

12. Responsibility and limitations

We are responsible for losses caused by our breach or failure to exercise required care, subject to applicable law. We are not responsible for loss caused solely by your unauthorised misuse or inaccurate information that we could not reasonably detect, where we did not contribute to that loss.

We cannot promise uninterrupted website or third-party availability. If an event outside our reasonable control affects performance, we will take reasonable steps to reduce its effect and address the affected purchase. This does not cancel our delivery duties, justify indefinite delay or remove legally required remedies.

For business purchases only, where lawful and reasonable, we exclude indirect or consequential business losses, including lost profits only to the extent they are indirect or consequential. This exclusion does not remove an expressly accepted obligation. Consumer rights and recoverable consumer losses remain governed by applicable law; this business exclusion does not override them.

We do not exclude liability for fraud, for death or personal injury caused by our negligence, or for obligations and remedies that applicable law does not allow us to exclude.

13. Protecting the store

We may proportionately restrict access to a misused function where reasonably necessary to address a serious breach, fraud, infringement or security risk. Where practicable, we will explain the reason and allow a reasonable opportunity to correct a remediable issue; urgent protective action may be necessary.

Restricting website access does not automatically revoke a compliant product licence, forfeit payment or erase a purchased entitlement or mandatory remedy. Any termination of a materials licence is governed by the Licensing Terms and applicable law.

14. Disputes and applicable law

Contact us if you have a concern so we can try to resolve it. Contacting us first is not a condition for exercising statutory rights, making a lawful payment dispute or approaching a competent court or authority.

Applicable law and jurisdiction are determined by the rules that legally apply to the agreement. These Terms impose no exclusive foreign court, compulsory arbitration or class-action waiver. Nothing deprives a consumer of mandatory protections or a right to use a competent local court where available under applicable law.

15. Changes and continuing agreements

We may update these Terms for future transactions. A website update does not silently amend an earlier purchase, licence or accepted project agreement. Any change to an existing agreement requires the notice or consent required by applicable law. If a provision is not binding, the remainder applies only where it can lawfully and fairly continue.

Any future Producer Club subscription requires separate terms disclosed and accepted at launch. These Terms do not offer a membership for purchase.
